What is a trademark?
A trademark is usually a company or product name that allows people to recognize the source of the product or service.
The Trademark Process
Search and Application
Select a strong trademark, search to see if there is a similar mark in use, and start the application.
Examination
A trademark-examining attorney will review the application to ensure it meets all of the requirements. This includes searching their trademark database, researching the trademark's meaning in your industry, and reviewing the identification of goods or services.
If it meets all of the legal requirements and there are no substantive issues the trademark will be approved for publication.
Possible Rejections
If the trademark is not registrable, the examining attorney will issue an office action, explaining why it was rejected and suggestions for fixing the application. The office action must be responded to and the problems corrected by the stated deadline. The attorney will approve it for publication if all problems are fixed.
Publications
The trademark is published in the US Patent & Trademark Office online Trademark Official Gazette. It is not yet registered and anyone can oppose the trademark within 30 days of publication if they think they will be harmed by the registration.
Allowance, Statement of Use, & Registration
For intent to use trademarks in commerce, USPTO will issue a Notice of Allowance, meaning you must submit a Statement of Use by the deadline. The SOU must have a specimen showing how you use the trademark in commerce.
Registration occurs after the Statement of Use or after the Notice of Publication for use in commerce trademark applications.
Maintenance
To maintain the trademark, you must:
continue to use the trademark in interstate commerce
file registration maintenance documents and pay required fees on time
keep correspondence information updated
